Why You Need a Licensed Site Remediation Professional (LSRP) in 2012
May 7, 2012 marks the date that all (with a few exceptions) new and existing environmental site remediation cases in New Jersey are required to retain a Licensed Site Remediation Professional (LSRP). Since 2009, the New Jersey Department of Environmental Protection (NJDEP) has been working toward significant changes to the Site Remediation Program (SRP), and full implementation of the Site Remediation Reform Act (SRRA) and the Administrative Requirements for the Remediation of Contaminated Sites (ARRCS) rule. The SRRA establishes private-sector Licensed Site Remediation Professionals that must oversee remediation of essentially all contaminated sites in New Jersey.
You may have received a letter from the NJDEP regarding your need to hire an LSRP to manage your environmental project. As the person responsible for conducting remediation, you must retain an LSRP and conduct remediation in compliance with the SRRA. The SRRA establishes an "affirmative obligation" for responsible parties to remediate discharges at their site.
The "affirmative obligation" of responsible parties to remediate contaminated properties is a fundamental aspect of the SRRA that also establishes new regulatory and mandatory timeframes. Failure of a responsible party to meet the established timeframes may give rise to penalties of $20,000 per day, and potentially the dreaded "direct oversight" by the NJDEP.
The NJDEP Site Remediation Program has essentially shifted from an NJDEP-lead case- management program to a private-sector LSRP-lead system. Whether you are the responsible party of a contaminated property, or are involved in any way with the transaction or remediation of a contaminated property, the new NJDEP rules and LSRP program will affect you and must be seriously considered.
